Scottsdale Arizona is located in the north east corner of the Phoenix Metro area. 3rd Party Buying Tips What You Need To Know

Save Your Money and Be Smart!

As your investment profile grows larger and larger you?ll notice that assigning a family member, wife or good friend to a home could be a definite advantage on your overall net worth. Especially in a rising real estate market where you can re-sell the property at a higher price before the completion date. Since half the property value is added onto your net worth, depending on the tax bracket your in, it might prove necessary to do a 3rd party buying. In this situation it?s important that in your contract you do not use ?and or nominee?. But rather be straight forward with the name of who the purchaser is.

The general rule is that a buyer may assign their rights under the contract as long as they do not prejudice the rights of the seller. The seller must know who the buyer is. However, if the seller does not feel her rights are prejudiced then the seller may consent to the assignment identity not to be required. This is provided that you have notice in writing of the assignment. Both buyers and sellers should receive copies of this from their realtor.

If your still debating whether or not to have an assignment sale or 3rd party as ownership then you may impute a temporary clause to give you a few extra days to contact your assignee or 3rd party to ask for their permission. Your realtor will insert a ?Assignment Option Clause? which should read something like the following sample clause:

?The buyer reserves the right to assign this contract in whole or in part to any third party without further notice to the Seller; said assignment not to relieve the Buyer from his/her obligation to complete the terms and conditions of this contract should the assignee default.?

Of course this is only a sample of what a realtor MAY use and should not be taken by person as a clause without first contacting their lawyer. When buying always remember the issues that affect an owners interest. You should keep your eye on the road. Rights-of-ways, passage or road widening may not have been surveyed or registered. Driveways and culverts may not have been constructed on any public roads without the permission of the Ministry of transportation. Permission could also be denied due to limited access roads.

Also, when building near to streams, rivers, oceans, lakes and cliffs; be sure to check your restrictions. You may find that the property your buying will be shrinking before your eyes in a matter of months. Learning And Teaching Social Skills: A RelationshipBased Approach

For those of us committed to helping children overcome learning challenges, the quest to teach social skills is particularly important. Social learning impairments are associated with a wide variety of learning disabilities, although they are especially problematic for people with nonverbal learning disabilities (NLD), noted to have underdeveloped right-hemisphere abilities, including deficits in:

? reading facial expressions
? perceiving emotions
? using nonverbal communication (body language)

The constellation of social skills deficits often encountered in school age children are perhaps best described as pragmatic communication deficits, which encompass challenges understanding social conventions and applying social cognitive skills. On the next page you will find some common examples of pragmatic communication skills. This information is taken from my book, Boys of Few Words: Raising Our Sons to Communicate and Connect, ? 2006.

Pragmatic (Practical) Communication Skills

**All these skills should be considered in an age-appropriate context. Many of these skills are developed in adolescence. Compare your child?s abilities relative to his peers.

PHYSICAL

? Maintaining appropriate conversational distance
Example: Other children may complain that ?he?s bothering me,? or say ?tell him to stop touching me? while playing together. Sometimes inserts himself physically into a group of children by pushing or nudging others out of the way in order to join the conversation.

? Eye contact
Example: Doesn?t look others in the eye; hides behind hair/hat/sunglasses; stares to the point of discomfort.

? Linking gestures with ideas and emotions
Example: Body language doesn?t match speech (thanks you for giving him a desired gift but slumps and stares off into space); waves too strongly or too unenthusiastically for the circumstances; forgets to reinforce emotion with body language.

? Using facial expression effectively
Example: Facial expressions don?t convey interest in other people; expression is not congruent with topic or situation; doesn?t nod to show he gets the point, looks furious at small disappointment; forgets to smile.

VERBAL

? Attending to time and place
Example: Talks too fast; doesn?t know when to interject a comment or let others speak, doesn?t know how much information to share (goes on and on about a subject to someone?s obvious irritation).

? Turn-taking
Example: Consistently interrupts; doesn?t perceive when it?s someone else?s turn to talk.

? Voice modulation
Example: Has trouble with prosody (pitch, tone, volume, inflection); speaks too softly or loudly without regard for physical proximity (you?re across the room but he doesn?t raise his voice to answer you).

? Giving compliments
Example: Doesn?t know how to give a compliment relevant to a person and circumstances; sometimes unintentionally insults people (?you?re a lot less fat than you were?).

? Greetings and Good-byes
Example: Doesn?t know how to introduce himself to individuals or groups; can?t initiate social contact (avoids parties and gatherings); doesn?t know how to close a conversation (just walks off when he?s done talking); doesn?t shake hands/share hugs with close friends or family members; forgets to say ?hello?.

THINKING

? Detecting emotions in other people
Example: Doesn?t consider other people?s emotional state before speaking (you?re in the middle of an argument with someone and he asks you to make him a snack); doesn?t realize when it?s time to ?back off?; doesn?t read signs about how you feel (thinks you?re mad when you?re not)

? Perceiving and expressing humor
Example: Takes jokes, sarcasm or irony literally; laughs at inappropriate times; doesn?t engage in word play or friendly teasing with peers.

? Knowing how to make conversational transitions
Example: Forgets to take his turn in conversations (calls you up on phone and then says nothing); discussions filled with uncomfortable ?dead space?; doesn?t pick up on ?leads? to continue conversation (So, you like baseball? Who?s your favorite team?)

? Anticipating other people?s reactions
Example: Neglects to consider the impact of his words before speaking; can?t easily imagine how his words or actions will be perceived by others (says he likes one present more than another at his birthday party without anticipating that someone?s feelings will be hurt).

Why Are Social Skills So Hard To Learn?
Most people use social skills quickly and automatically, and as a result, don?t have the benefit of time to analyze which skills will be used in particular situations, or how best to apply them. When our social reflexes are well-attuned and effective, we don?t need time to think - we just do and say what comes naturally.

Important to emphasize is that social skills are built on a foundation of interpersonal awareness. Without an appreciation of other people?s nonverbal behavior, including sensitivity to nuances of language rhythm and intonation (prosody), it is difficult to formulate appropriate and constructive verbal and behavioral responses. In addition to having a basic awareness of other people, having an empathetic orientation toward others is very helpful in bolstering one?s intuition about how to relate effectively. As some readers may be aware, a disproportionate number of children and adolescents with learning disabilities are observed to have low empathy.

To be in an empathic relationship with another person or group is the opposite of self-absorption. Empathy implies a departure from a state of self-centeredness, and immersion into the subjective experience of others. By definition, empathy is prosocial, because it emphasizes the value of comprehending and appreciating the thoughts and feelings of other people.

We all function in various types of groups: families, schools, teams, neighborhoods, and communities, among others. Social skills make our participation in these groups easier and more satisfying. Although lack of empathy has been associated with the presence of NLD, I would argue that what is missing for many learning disabled children are overt expressions of empathy, as are often conveyed through pragmatic communication. This is very different from the absence of empathy found among antisocial children and adolescents.

Many children with nonverbal learning disabilities are better understood as being asocial, meaning that they can appear indifferent to social interaction.

We Can Help Teach Children to Solve Their Own Social Problems
Not long ago, I was leading a social skills group for 3rd and 4th grade boys, about half of whom had been identified as having a learning disability. We were huddled in my office with kids bunched on sofas, sitting on the floor, and twirling in my desk chair. One seven year-old boy, Grant, resisted joining in our group activity, which was to design and build a big ?cyborg?. He stood near the door on the periphery of the group with a scowl on his face and body language that conveyed his fear and distrust of the group. Grant wasn?t responding to cajoling and encouragement to join us. I tried all kinds of approaches, changing the tone of my voice and my facial expression, in search of the combination that would help him join in. Still, he would not budge.

Several years earlier, my frustration probably would have resulted in me taking Grant outside and pleading with him to sit down and join the group. That?s because I used to have the faulty impression that ?leading? a group, meant ?controlling? the group. Since then, I have come to appreciate the extraordinary strong will of boys to do things in ways that reflect their own logic about how problems should be solved.

As the situation unfolded, it became apparent that Grant?s resistance provided the boys with a good problem-solving opportunity, and so I posed a question to the group. Did anyone have any ideas about how we could get Grant to join us? Most of the kids responded with suggestions of various kinds of rewards: games, candy, or premium seating (twirling chair). One typically shy boy, Tyler, suggested we could ?buddy-up? so that everyone could have a partner, including Grant. Tyler also suggested that buddies sit next to each other so they could share tools. Most of the boys agreed this was a good idea and so we began a discussion of how buddies would be chosen. Again, Tyler spoke up, suggesting that Grant could pick his buddy.

Throughout this process, I was watching Grant closely, and was struck by his awareness of the group?s concern about him. His facial expression changed from one of distrust to a cautious grin. He?d obviously had some significant doubt about whether the boys would accept him, and how he would fit in ? figuratively and literally. Tyler?s leadership in breaking through his fears paved the way for his integration in the group. As you might imagine, I felt very proud of Tyler for his sensitivity to Grant, and his ability to apply that sensitivity through active problem-solving. Although he never verbalized Grant?s feelings, Tyler?s suggestions were, emotionally speaking, quite sophisticated, and reflected an understanding of what Grant was feeling.

Socializing is not a ?Logical? Process
When we think about teaching social skills to children, it is a natural step for us to begin thinking about skills as component parts of a larger system. While this may be a logical and practical way to go about the teaching of a ?system,? it is not necessarily the best, or only, aspect of a therapeutic process designed to facilitate the development of social skills.

In addition, for individuals such as psychologists or counselors who may teach social skills, there is a tendency to systematize the teaching of such skills in limited periods of time, such as teaching one skill per session for 12 ? 15 weeks. When social skills are taught to groups this approach may be inevitable, but when working with children individually, there is typically more latitude, including allowing the child to play an important role in how the learning evolves. Experience has taught me not to exclude the importance of the relationship between teacher and student, or therapist and client, in helping children integrate new skills. In this sense, professionals allow the process of learning to be as organic as would be the process of healing syndromes like depression or anxiety.

An excellent working alliance is a critical foundation for learning most things, including how to relate to others.

This is because gaining social competence is more than conceptually grasping ?skills,? it also involves relaxing enough to take risks ? trying new things with uncertain outcomes.

From Skills to Awareness
Perhaps we need to remember that for the brain and mind to integrate new ideas, a fertile ground of receptivity must first be prepared. That receptivity often springs from an effective, trusting, working alliance. For many children, this means engaging in therapeutic and relational activities that are not purely didactic, because such structured activities are often associated with domains where they lack success. In other words, you can make it fun ? play is the work of children.

While I would never want to give up my use of behavioral charts and records, or surrender my collection of therapeutic games designed to teach things like communication pragmatics and listening skills, I have come to believe that those exercises are somewhat empty without a solid alliance between my clients and myself.

The alliance gives children and teens the capacity to be receptive. Sometimes, people may not even be aware of their own resistance to learning new skills. For children with learning disabilities, these walls often come down slowly, but they do come down with tools like patience, commitment, and belief in the desire of children to connect with others.

Anything that might help a child connect the development of social awareness with a positive outcome should be considered a potential tool. Still, we should remember that what we are building with these tools is a mind, and a mind is not a machine ? it is the very essence of being a person. We simply can?t program a mind according to standards of efficiency without regard for the individual within whom that mind lives.

Help I Have to Evict My Nephew!

The eviction of a friend or relative is not easy to do. It has to be one of the most difficult lawsuits, if not the most emotionally draining, of all types of evictions. You may be one of the lucky ones who can rent to a friend or relative with no side effects. Still one day, there may come a time when you have to look your friend or family member in the eyes, and ask him or her to leave your apartment.

In the eviction of a relative stranger, even a long-term tenant, the process isn?t personal, just business. The tenant can?t pay the rent, so he has to leave. It?s the end of an association with more or less minimal emotional ties between the tenant and the landlord.

Evicting a friend or relative is one in which sides may be chosen, and lines drawn in the sand. Once the eviction notice has been delivered, do not expect many friends or allies to come to your aid. Depending upon the circumstances of the eviction, you can expect to have your life made miserable by anyone impacted by your decision.

This is because the expectations of a friend or relation are much higher than that of a stranger. If there is a tenancy problem, the expectation is that you will treat the tenant more as a friend or relative than as a financial investment problem. You will be asked to accept less than you normally would for rent arrears, to wait longer for your rent, and to accept behaviors that you would not normally tolerate.

For example, let?s say you need to raise the rent. A rent increase could be perceived as a betrayal of your friendship. Your aunt could think you are taking advantage of her. It doesn?t make sense, but when money is concerned, all bets are off. As far as a friend or relative is concerned, you are in his or her pocket. A belief that you are soaking your tenant for more money that you ?don?t really need? could cause your family member to not pay the increase.

Be clear and resolved about why the eviction must take place. Have all of your written documentation in place. Check all of your paperwork, rent cards, letters of warning etc. before you send your notice to quit. Make sure you have a leg to stand on before starting the eviction case. Conduct a due diligence of your property and the legal case.

Hard feelings will sometimes come with the rental and eviction territory. Do not expect to be able to discuss the case calmly with the offended tenant. Do not expect a cool head to prevail over your eviction action. If you evict your nephew, expect your sister or brother to be totally ticked off at you. Your friend may think you are a jerk for evicting her because she parties loudly every weekend, disturbing your other tenants. Your aunt may not come to your aid when your niece does not pay the rent.

When blood is evicting blood, much more blood could be shed before the battle is over. Few people want to be in the middle of a turf war. You may find yourself isolated and alone during the eviction process until the dust has settled. This is the reason why most landlords refuse to rent to a friend or family member. It is preferred to have only one relationship, than to confuse the personal relationship by adding a legal one.

How can you ease the pain of evicting a friend, relative, or even the relative of a friend? It could depend on how the person was moved in. Were you doing your friend ?a favor? by renting your apartment to him or her? Did your cousin have to complete a rental application like everyone else? Did you verify all references, employment information, credit check, former landlord information, etc.? Does the tenant have a lease?

Why is this important? Having everyone go through an application process regardless of their status with you establishes the ground rules from Day One. Without it, the tenant could feel that he or she was taken in as a friend, and then treated otherwise when things got tough. It helps to set up the lines of separation between the friendship and the tenancy.

So, what is the best way to evict a friend or relative? Here are some tips:

?First, do not take shortcuts during the legal process. In fact, do everything strictly by the book. A wounded friend or relative who knows your personal business becomes a worthy adversary in a legal case. He or she will use whatever information is available to fight you tooth and nail.

?The jury is still out as to whether or not you should serve the initial notice of lease termination personally, or use a constable. The friend or your sister will feel the sting of you starting legal action just as shocking no matter how the news is given.

?Exercise the same professional manner in dealing with the loved one as you would with a stranger. Try to keep your emotions out of the situation. Avoid discussing the case at length with your now adversarial tenant. The less said, the less information that can be used against you in court.

?Put any rent arrears payment plans in writing. Continue the eviction case, and present the payment plan to the judge. Have the judge enter the payment plan in the court decision. Then, if the plan is broken, it is broken with the court, not you. Your friend or cousin will be less likely to violate a court agreement.

?Some landlords hire an attorney to process their eviction cases specifically against a friend or relative. When your best friend or nephew calls you about the eviction notice, refer all comments and questions to the attorney. Resist the temptation to explain why you started the action. With an attorney, you are taken out of the middle position. Let the lawyer earn the fee by listening to the anger, frustration and feelings of betrayal by the friend or relative.

?If you need to take legal action against a friend or relative who is your tenant, do it. Do not be intimidated by their personal association with you. Your real estate is a business investment. If you remember this during the process, you will be able to separate the two relationships, that of friend or family member who is also your tenant.

No one wants to be evicted, especially by a person who is considered a pal and confidant. The bitter taste of humiliation, feeling of betrayal, and anger will remain long after the actual legal action. Before renting your vacant apartment out again, remember the experience. Decide whether or not the rent is worth the possible loss of friendship or family discord.

A board game is any type of game that is played on a marked surface (board). Some are simple and considered family entertainment, while others are intricate and involve a plan or strategy in order to win.

Flipping and Capital Gains

A common dilemma for real estate investors is the issue of flipping and taxes. In this article, we look specifically at the tax issues associated with flipping and capital gains.

In recent years, people have been looking at the real estate market as they once looked at the stock market, eyes filled with dollar signs. Flipping became a popular real estate investment strategy to make fast cash. However, one thing that people forgot in their haste to play the game was to be properly prepared with the knowledge to avoid paying high taxes on their profits. Towards that end, here's some noteworthy information about taxes as you think about your flipping strategy.

First, in order to avoid overly onerous "ordinary income taxes" on flipping properties you must have the property treated as a capital gain. Most often, if you sell the property in less than a year, you will be taxed at the ordinary income tax rate, which can be in excess of 35 %. Only when you've held the property for more than a year, does the long-term capital gains tax of 15 % (for most tax payers) come into play. In order to have the property treated as a capital gain you must show that you had no intention of flipping that property. Ironically, this could entail holding the property for this extended period of time which counteracts the whole point of flipping - which is to make money fast.

Also, it's not only about "when" you flip, but about "how often" you flip. If you flip too often, the IRS may view that this strategy is your "trade or business" and therefore the profits you make are subject to ordinary income and self-employment taxes. And you don't want that.

Secondly, if you want to employ other strategies to avoid big taxes like installment or structured sales or private annuity treatment while flipping, you can't. Spreading tax out doesn't work because the property is not labeled investment property. This again goes back to issue of holding periods and intention of sale.

If you are hoping to use the 1031 exchange strategy as the approach for flipping and capital gains, again you will find yourself between a rock and a hard place. 1031 exchanges are reserved for investment properties only and if you can prove, through holding periods and intention, that the property is a capital gain or investment property, you will not be eligible. The IRS supports investors and savers, not speculators and gamblers.

Once most of your tax deferral options are exhausted, your last resort for flipping and capital gains may be to have that property re-characterized to a capital gain property by moving in to it and treating it as your personal residence. It may work, but holding even longer holding periods apply.

In conclusion, flipping can be an exciting and fast way to make money. But when it comes to taxes it is hard to make flipping and capital gains work together.

Lets get one thing straight; despite what you may be told, you dont need a nursing bra to successfully breastfeed. Illinois Foreclosure

There are two (2) types of foreclosures in Illinois: 1) Consent Foreclosure and Judicial Foreclosure.

Both are used in the state for specific purposes.

1) CONSENT FORECLOSURE

A consent foreclosure is when a bank either by filing a complaint or a motion agrees to:

1) Waive any and all rights to a personal judgment against all homeowner and guarantors.

2) The offer is made in the complaint or by motion with notice to all parties.

3) All lenders expressly consent by answer to the complaint.

4) No other party objects to the entry of judgment.

OBJECTION TO CONSENT JUDGMENT

Any party with an interest in the mortgaged real estate can object to the consent judgment. If an objection is lodged:

1) a hearing is ordered

2) The objecting party must show good cause why judgment should not be entered ( loss of lien)

3) Judge will then determine the required amount to redeem the property and keep it out of foreclosure.

4) Judge will give the objecting party 30 days to redeem and get title vested to it.

The order is for the objecting party with the least priority to pay up the line. Failure of the objecting party to pay allows the court to order objecting party to pay interest and costs including attorney fees for the 30 day delay.

2) JUDICIAL FORECLOSURE

The complaint is filed in the court and must contain the following information:

1) Name of the parties: Required parties are the lender and all homeowners, other parties are:

a) All parties with a possessory interest in the real estate.

b) Spouse of owner who has waived the homestead.

c) Guarantors of the note

d) State of Illinois

e) United States ( IRS liens etc)

f) Any assignee of the mortgage or the property

g) Any holder of a mechanics lien

If a party is not named in the foreclosure, they may intervene at any of the following times:

1) Any time prior to the entry of judgment.

2) 30 days after notice has been given.

3) By courts discretion prior to the sale date.

4) After sale but before order confirming sale: Here the lien holder only receives a claim on the proceeds of the sale not any interest in the real estate.

2A) WHAT IS CONTAINED IN THE FORECLOSURE COMPLAINT

In each foreclosure complaint the following information must be included in the complaint:

1) Name of the parties

2) Copy of the mortgage will be attached.

3) Copy of the promissory note will be attached.

4) Nature of the mortgage instrument.

5) Date that the mortgage was entered into.

6) Name of bond and homeowner

7) Date and location of the recording of the mortgage

8) Legal and common description.

9) Statement of the default

10) Name of the present owner

11) Name of all persons joined in the action to terminate their interests

12) Name of person?s bank is looking for a deficiency judgment against.

13) Facts supporting a shorter period of redemption from seven months from date of service of summons or publication or three months from the entry of judgment

Reasons for a shorter period of redemption

1) Nonresidential Real estate ( 5 family or more)

2) Abandonment

3) Value of the house is less than 90% of the amount owed.

REDEMPTION AND REINSTATEMENT PERIOD

REINSTATEMENT RIGHTS

The homeowner is allowed to reinstate the loan in default up to 90 days after service upon all parties by paying the outstanding bills.

If the court finds that the homeowner has reinstated then they are barred from reinstating again on the same mortgage for 5 years.

The homeowner can waive the right to reinstate only after the commencement of a foreclosure complaint. The waiver must be done in writing and the bank must waive the deficiency judgment.

REDEMPTION RIGHTS

The owner and a senior lien holder can redeem the property prior to the auction. The redemption period is the later of:

1) 7 months from the date of service of the complaint.

2) 3 months from the date of judgment.

There are two (2) exceptions to the periods listed above they are:

1) 60 days after judgment if the court finds the value of the real estate is 90% of the judgment amount. See consent foreclosure.

2) 30 days after the judgment if the property has been determined to be abandoned.

The redemption period can be extended by order of the court. It must be a specific order.

SPECIAL RIGHTS TO REDEEM WHEN BANK WINS THE BID

If the bank wins the bid, the previous owner shall have a special right to redeem the property for a period of thirty days after the confirmation of sale.

REQUIREMENTS TO REDEEM PROPERTY

The homeowner must pay the attorney for the bank the required amount within the period of redemption.

If the bank refuses to accept payment or if the owner objects to fees, then the owner shall pay the full amount into court along with a written statement specifying the objection.

The clerk will then forward to the bank all nonobjected to funds. The clerk will then give a receipt to the owner redeeming the foreclosure and file the receipt in the foreclosure record. The bank must then promptly furnish the owner with a release.

Objection Procedure

1) Clerk holds the amount objected to.

2) Hearing is scheduled

3) Court makes order determining what needs to be paid

Right to possession of the property

1) Prior to the entrance of the judgment and up to 30 days after the confirmation of the sale the property will be occupied by the homeowner.

2) After the appeal period 30 days after confirmation of sale property to the high bidder.

3) The court that confirmed the sale can hear and grant a supplemental petition for possession. ( kick out of prior tenant)

Conclusion:

Basically the foreclosure procedure takes about eight months from the filing of the complaint to the confirmation of the sale in this state. Certain advantages need to be taken into account. They are:

1) The auction is not the last say on the property. We can and should chase the homeowner up to the confirmation of sale.

2) In the event that the bank wins a bid we have 30 days from the confirmation of the sale to talk with the homeowner and make a deal.

3) Judicial foreclosure state we will need a lookup specialist in the court house.

Top 10 Critical Mistakes Homebuyers Make and How to Avoid Them (Part One)

1.Using an out-of-town lender.

Getting a mortgage in a timely and hassle-free manner is the ?key that opens the door? to your new home.

Lenders who don?t live in the area you are buying in will not have the contacts needed to process your loan in an efficient and timely manner. Are you aware that if your lender fails to get you your loan on time, that your earnest money deposit may be at risk of being forfeited?

Your best bet is to ask your real estate agent whom they have used before and who they trust.

If it is important to you to use a lender from out-of-state (family member, friend etc.), your best bet is to have your lender refer your business to a local lender. This will help insure that your out-of-state lender receives a referral fee, they don?t violate state mortgage laws, and most importantly you are able to close on the home you want to buy.

Mortgage story: The very first transaction I was involved in after I got my real estate license was a nightmare due to a negligent lender. I was representing a buyer from Las Vegas (I live in St. George, Utah) that insisted on using a Las Vegas lender. Unfortunately the lender would rarely return calls or answer his phone. He failed to close on time. We extended the closing date time and again, and time and again the out-of-state lender failed to have the loan ready. The buyers were frantic and the sellers were angry. Finally eight weeks after we were supposed to close my buyers finally dropped the lousy lender and went with a local lender that I recommended. To my buyer?s amazement, by using the local lender, we closed the transaction 10 days later.

2.Not using a loan approval letter when making an offer on a property.

You?ve found ?The Home? and want to make an offer to buy it. Now anybody can make a full price offer and get it accepted.

What if ?The Home? is priced at $275,000 but you offer $250,000 and say that you will pay for the home by getting a new loan?

The sellers, when presented with your $250,000 offer, know nothing about you except that you seem to think their home is worth less than they feel its worth. At that point they will probably do one of two things. They might reject your offer outright. Or they might counter your offer at close to their asking price. As far as they?re concerned they never considered your original offer to be a ?real? offer.

Do you think that they would have taken your $250,000 offer more seriously if you had said you could pay cash? Of course they would have, after all money talks.

What if you had already received full loan approval from a lender. Not just pre-qualified, or pre-approved (Being pre-approved is kinda like being pre-pregnant), but fully approved for a home loan with a letter from the underwriter to prove it. A letter that is as good as ?cash in the bank?. You?ve become a ?Power Buyer?! You never know, maybe the seller would accept your offer, rather than letting a good buyer get away.

Wow, if your offer was accepted, you just saved $25,000 on the purchase of your home! And all you had to do was meet with the lender before you went house hunting.

3.Buying too much house for your income.

I used to do ?Broker Price Opinions, or BPO? for banks. This is where a bank would contact me to find out the value of a home that they had given a loan on. Often times this ?BPO? was because the homeowner was losing or had lost their home because they could no longer afford the home. What a terribly sad event for that family.

Things happen in life that you might never expect. Don?t unknowingly ?open the door? to future foreclosure and bankruptcy by getting a mortgage that you can ?grow into?. Life rarely works out the way you expect.

One of the best moves I?ve ever made was purchasing my current home. When I bought this home I qualified for a home twice as expensive as the one I bought. Payments on my home rarely cause me stress or concern.

4.Thinking ?short-term?.

Want to really scare me? Tell me you want to buy a home today and that you will want sell it in two, three or four years. Yikes! Talk about wanting to lose money.

Real Estate home values generally rise very slowly in a slow or soft real estate market. In St. George, where I live, our average time between hot markets (when home values rise quickly, usually doubling) is ten years. If you bought $250,000 home in a slow market, in three years it might be worth $265,000. Your cost to sell with commission and other costs would be $18,200. You would lose $8,200 for your short term thinking.

If you have to move within three years of buying a home, it would be better to use the home as a rental for a few years, and sell it when the market will allow you to make a profit. Better yet rent it out until the top of the next hot market, then sell it and potentially make $250,000 profit.

5.Using 1031 exchange money to buy personal property.

Do you really want to risk having the IRS charge you with fraud? Enough said.

Starting about the first week in December (my wife and I celebrate Christmas), it seems like everywhere I go people are asking something like How's the Holiday shopping coming?, or Have you started your Holiday shopping yet?. You should see the looks of disbelief I get when I answer a resounding Yes! I'm all done. And, In most cases, the querying party admits that they have not even started, even if it is only a day or so before the blessed event. I feel for them!

You see, a few years ago my wife and I discovered a way to take the panic out of holiday shopping for gifts. And, when I give friends, business associates or sales clerks my Yes! answer, and explain why I am able to respond truthfully in this way, in most every case, our method of holiday shopping is something they have never considered before. It's not profound in any way, really, just practical and maybe a little out there to most, apparently.

There was a time only a few years ago, when we used that last couple of days before to frantically compete elbow to elbow with other like panic-stricken, wide-eyed scramblers. First of all, buying for each other - worrying about sizes, styles, tastes, would this look good on me-isms?, colors, etc., just about drove us nuts every year, anyway. Maybe you've been there too.

In an initial effort to retain a modicum of sanity during this rush, we started a holiday list about mid-summer with items we might want or need at the given time we wrote them down. These lists were exchanged a week or two before opening time. This method really didn't relieve the pressure or challenge of the above mentioned problems.

Then, there was still the additional headache of what we would buy for the friends and family members we exchange gifts with. I hate to say it, but all of this uncertainty and trauma over what is supposed to be a joyful season, really took a lot of the enjoyment out of it for us.

Again, I want to emphasize, that our unlikely method is not an earth-shattering discovery on our part. It is just a practical approach for two busy people who have most everything of a material nature they will ever need. And, we always get gifts of things we really want! I love that about it.

Okay, enough with the grand buildup. Here's what we do now. In late summer, we start getting a major bevy of catalogs. We must be on every mailing list in the Universe. That's okay, though, we want to be. You see, by looking through these wish books, we can bookmark items we really like, and ones we perceive some sort of need for. At least, they are items in styles and colors, or gadgets, that we really like, could really use. And, by sometime around Thanksgiving, each of our turned down pages, denoting our circled wish list items, has grown to a substantial number. A lot of the items have probably even been forgotten by then. Then, we just integrate items on this list into our respective budgets and order. It's that easy. The orders are filled quickly, there is plenty of time to make exchanges if necessary, and the gift receiver is able to exchange anything that doesn't fit or doesn't' look like it did in the catalog.

Well, there you have it. Not profound, but easy and effective. And, for whatever reason, the vast majority of my holiday shopping questioners I mentioned before, have never even thought of doing this. Maybe you have, but you would be in the low minority of the circles I travel.

CONFLICT IS A WORDCoach Maureen Killoran

Conflict is a word many of us either were taught or learned by experience to avoid. Fighting. Nastiness. Anger. Family Feuds. On a national level, conflict connotes failed diplomacy, armed warfare, environmental devastation, even genocide. My dictionary describes it as an ongoing state of hostility between two groups. Makes me shiver.

When you turn to contemporary peace studies, however, a broader definition begins to emerge. Not only in cases of radical disagreement or ill will, today scholars understand that conflict can also occur in cooperative situations, in which two or more parties have mutually compatible even the same -- goals, but when they try to achieve these goals, the parties disagree about methods, and get in one anothers way.

Ive been there. So have you. (Cmon, fess up. Nobodys listening except you.)

Conflict can be polite, friendly, agreeable, cool, barely civil, angry but if there is disagreement over goals, resources, or methods its conflict all the same. Social scientists who love typologies divide conflict into several levels of analysis intrapsychic, between individuals, within or between groups, within organizations, among the various aspects of a community, at the level of the state as in civil wars and election campaigns, and between nations.

Systems theory teaches that conflict manifesting at any of these levels may appear nested in conflicts residing at larger levels of analysis. For example, conflict within a committee may play out the dynamics of a broader conflict in the organization as a whole and vice versa.

Before your eyes and brain glaze over, let me move to what I found to be the most useful information for those inevitable times when conflict comes around:

High concern for only the other partys outcomes leads to backing away. The other party may win but the conflict goes underground.
High concern for only ones self and ones own outcomes leads to attempts to win.
No concern for either sides outcome leads to attempts to avoid the conflict. Lets make nice and the conflict will go away. (Not.)
High concern for both ones own and the other partys outcomes leads to attempts to find mutually beneficial solutions. The Quaker question in times of conflicted decision making is helpful here Is this proposal an outcome you can live with?

Theory only goes so far. Im still conflict averse. But its comforting, somehow, to know that conflict is not a sign of pathology. Conflict is natural aspect of every human community. Its how we deal with conflict that matters. Now. Today.

Beginner Backgammon Strategy Points

Backgammon is pretty much a race to see who can get their checkers off the board first. This can be accomplished easily but it depends on how you move your checkers around the board. Here we will look at some that can help you win and make your opponent a little dumbfounded.

While it may seem stupid to let yourself lose a piece to your opponent early on, it actually might be smart. In the beginning, you both have less pieces in your home board, and thus it?s easier to get those checkers back into the game and around the board to your own home. The more pieces your opponent has in their home board later in the game, the harder it can be to get those back on the board to do anything. So leaving one or two checkers open can make it easier for you later when you have your checkers almost all home and on the way off the board to win.

Your distribution of checkers is a big part of how to win. You should try not to have six on any one point. Definitely don?t have more than six; it makes you an easy target to get crunched in by your opponent. And while it would seem sound advice to have two checkers on four spots, it?s actually not a good move. Better to have three checkers on two spots at once. This is because the dice seem to fall better for more even distribution and improves your chances of winning the game.

Blocking can be a crucial part of winning. It is best to block your opponent in your home board. Here they will have a harder time getting out as you bring more checkers in to go off the board. This strategy works if you start early and get six checkers inside your home board early. This way you can block your opponent in and still get your own pieces into your home board. Six in a row is called a prime in backgammon. The best places to try and block from are points 4, 5, and 7.

To make an impact against your opponent, hit as many pieces as you can. However don?t just hit pieces to hit. Sometimes this can work against you. If your opponent has at least two bars in their home board, it is better for you to get your checkers home instead of taking out another checker of theirs. Don?t hit if it will leave you open to hits or blocks yourself. This is counterproductive to actually winning.

The final strategy move to help you win is called anchoring. This is where you have a strong spot on their home board. It helps if you get hit, you have a strong spot, an anchor, to move your piece back on the board safely. It also keeps your opponent from being able to go out themselves. And if you have more than one anchor it can help if you are behind in points early on. As well as making you stronger against your opponent. If you do have two points make them adjacent to make it harder for your opponent to move on their home board.

All of this isn?t guaranteed to make you win, but it can help you along the way. Used properly you can get 'lucky' rolls and make your opponent wonder just how long you have been playing.

Breast Augmentation Beauty or Beastly?


Breast augmentation surgery / breast enhancement surgery / breast mammoplasty / breast enlargement surgery / boob job -whatever name you use - it is a surgical procedure to enlarge small breasts or breasts that have lost their fullness. It may be undertaken to enhance the body shape if breasts are considered too small; to correct a reduction in
breast size after pregnancy; to correct a difference in breast size; or breast reconstruction after breast surgery.


Breast augmentation has been available in the United States for over 40 years. However the surgical techniques and implants themselves are constantly being refined, increasing the safety and reliability of the procedure. At this time over two million women have breast implants.


A breast implant is a silicone shell filled with either silicone gell or saline (salt water). There is however some restrictions on the silicone filled variety.
Silicone shells filled with saline solution are implanted either directly under the breast tissue or beneath the chest wall muscle, thus giving breasts a fuller and more natural contour.
Incisions are made where they can least be seen - usually the armpit, around the areola (nipple area), or under the breast itself.


There are 2 surgical techniques of placing the implants. The first is where the implant is placed under the breast tissue and over the chest muscle (subglandular placement).
The second method is where the implant is placed under the chest muscle and breast tissue. (submuscular or subpectoral placement).
The procedure is usually done under general anesthesia.
The surgery takes 1 to 1.5 hour and a bandage is then applied over the new breasts to help with healing for two days postoperatively. You would then attend a follow up appointment where you are given instructions regarding care and activity. After a post-surgical recovery period of 24 to 48 hours and an additional reduced-activity period of a few days, patients will likely experience soreness and swelling for a few weeks. Exercise and normal activity can resume at the direction of the surgeon.


Breast augmentation recovery is not a simple process. In most cases, the breasts that you see immediately after breast implant surgery are not indicative of the final results.


It is not until after six to eight weeks of breast implant recovery that the breasts finally take a shape of their own. Recovery continues until each person feels comfortable with their new breasts.
There are several different stages of the breast implant recovery process. Initially discomfort is to be expected. This discomfort can range from mild to severe, and can last anywhere from a few days to several weeks or more. The stitches that the surgeon uses to close the pocket around the implant will either dissolve on their own within a week of recovery or they will need to be removed by the surgeon seven to 10 days after surgery. Compression bandages or a compression bra are used immediately after surgery to prevent blood and fluid accumulation, speed healing and keep the implants in place during the early stages of recovery. If bandages are applied, they are usually removed within a day or two and replaced with a compression bra. This bra is usually worn for the first two weeks or more of recovery.
During recovery from breast implant surgery, it is common for some women to experience minor drainage, swelling, bruising and tenderness. To control swelling, it is often helpful to use cold packs and sleep with the torso elevated. Pain medication is often prescribed to reduce pain, and limiting activity during recovery will help reduce the risk of bruising.
For most women, the full recovery from breast implant surgery usually takes a few months. Everyday activities can usually be resumed with two weeks. However, as with all surgeries, recovery time is different for each patient.


Complications. Like any surgery some complications can occur. The most common problem - capsular contracture - occurs if the scar or capsule around the implant begins to tighten. This squeezing of the soft implant can cause the breast to feel hard - this can be treated - either by removal or 'scoring' of the scar tissue, or perhaps removal and replacement of the implant. Excessive bleeding after the operation may cause some swelling and pain - occasionally women develop an infection around the implant - some
reports of nipples becoming oversensitive, undersensitive, or even numb. Occasionally breast implants may break or leak.


Male breast implants. There are no significant physiological differences between male and female breast tissue other than the initial volume. The surgical procedure for male breast augmentation is identical. Through inserting an implant behind each breast, surgeons are able to enlarge a man's bustline by a cup size. Because men usually have less skin in that area it is recommended that they start with the smaller implant so that the body can get used to the new shape and stretch over the area.
Male breast implants, also known as pectoral implants, serve a separate purpose from transgender implants. Usually, male breast implants are designed to help sculpt the chest area and provide definition. Patients who opt for male breast implants often have experienced difficulty gaining their desired muscle definition through exercise alone.


Other candidates use male breast implants to mask problems caused by injury or growth defects affecting the pectoral muscles. Like liposuction, male breast implants can provide results that are otherwise impossible for certain individuals.
Unlike female breast implants, the male breast implants are made of solid silicone, which is inserted under the muscle tissue. During a male breast implant surgery, the surgeon will make small underarm incisions, creates pockets under the muscle tissue, and inserts male breast implants under the pectoral muscles. The surgery takes between one and two hours, and surgery for male breast implants is carried out on an outpatient basis, allowing the patient to return home the day that male breast implants are received. Recovery can take as long as six weeks, but most patients getting male breast implants are able to resume all activities within a month. Secondary surgery is rarely needed, and male breast implants are designed to last a lifetime.


Breast augmentation prices vary - but seem to range from $4,000 - $10,000. Finance is available for breast augmentation. Real estate bargains? With all the talk about a bubble, come on. Yes, there are areas in the country that haven't experienced the large run-up in home prices the last couple of years. According to the real estate research service, Local Market Monitor, six towns qualify as under-valued according to their most recent survey. An interesting note is that two are in Texas and all in more southern areas of the U.S.

It will be difficult to determine if these statistics will drive a boom in these communities. What To Look For When Selecting A Stroller

Strollers are one of the most convenient products ever designed for children and their parents. Today's strollers are available in such wide range of styles and models, it is often a difficult decision to choose just the right one.

Whatever type of stroller you decide to use, it is important to keep a few practical safety suggestions in mind. Always look for a stroller with some sort of braking system. Most models have small levers near the back wheels that allow you to lock the wheels and prevent the stroller from rolling. Apply the brakes anytime you stop for more than a brief moment. Anytime you stop the stroller on an incline, remember to point the wheels away from the hill, even with the brake applied. Choose a stroller with a secure seatbelt harness.

Five-point harnesses are typically much safer than a belt that only fastens around the child's waist. Board Games Starting Your Own Gaming Group

So, you're starting a hobby of board gaming, or you already enjoy gaming. Chances are that if you are single, you play them with some friends or a significant other. If you are married, you probably include the family. But, something is missing...the community element. Sure, your spouse likes a good game every so often, but wouldn't it be fun to have a group of new friends that either looks forward to the same games you like or brings new ones to the table, so you don't have to buy them. Today, with everything costing more, even entertainment, it is quite a prudent move to develop a group of friends that get together and share their games.

Three Fundamentals of a Game Group

So where do you start? A good game group needs at least three things:

1. A Host

2. A Place to play

3. Games

The host is the person in charge of the group. This can either be a rotating position - You work on it one month, Joe works on it next month, and Sally handles it the month after that...and so on.

Regarding the place to play, this can rotate also. A restaurant, a library, a YMCA, or simply someone's home will usually do the trick. Like the host, this location can rotate each month also.

Obviously, to have a game group, you need games. If you start with a few generic titles, such as Settlers of Catan, Ticket to Ride, Carcassonne, and Puerto Rico, you will have a good starting base to work from. After a few rounds with each game, you will see a pattern in what people like to play and you can even introduce other games to the mix.

Let's break this down to more of the specifics.

The Gaming Group Host

The function of this role is to coordinate the communication and location of the gaming event each time. The Host determines the when, where, and what gaming group. This is the reason you may want to have this be a rotating position.

Expect that the host will devote a good amount of time to running the group.

Your group's host should have a few important traits:

* Initiative
* Patience
* Good Communication Skills
* Ability to work with diverse people
* Be a good sport and promote fair play

The reason patience is listed as a trait is because you cannot expect to start a game group and have a bunch of people show up immediately. You have to build it over time - possibly months. There are examples of gaming groups taking years before they get just ten regular attendees. It can go the other way as well - start off with everyone bringing a friend and it grows from there.

Choosing a Good Location

The size of your group will determine the requirements for your group's location choices. Funding may also play a role - some places may want to charge you a fee for your time. For example, if you are in a room at the local YMCA, they may have a small fee for the room rental. If you choose a restaurant to sponsor your group, they may require you spend a certain amount of money on food and drinks.

Another option for a gaming location that may work great is someone's home. The only things to consider here are space and other family. If it is a small apartment, that may not work so well. If the family hosting the event has small children (under the age of about 6 or 7) they may create an unwanted distraction. When playing strategic games, it is hard for others to think while there are small children running laps around the house.

You need to have enough space to have one or two tables and enough chairs for everyone.

One of the most important requirements for a location is a restroom - gamers like to drink and eat.

Making a Gaming Location a Success

Supplies, supplies, supplies! Many games need an extra bit of scorekeeping or organization. The host needs to make sure these are available. Here is a short list:

* Paper - notebook or pad is fine
* Pens or Pencils
* Dice - in case someone lost theirs
* Sandwich baggies (to organize game pieces) - you may also want to use the smaller snack-sized baggies

Like I mentioned earlier, gamers love to eat and drink. Here are some suggestions to serve that need:

* Water
* Soft drinks - diet and non-diet
* Fruit - not fruits that makes a mess, like oranges
* Chips
* Pretzels
* Cookies

Don't forget the things that go with these items, like cups, ice, plates, and napkins.

If you wanted, you could go as far as having a full meal, such as pizza or burgers and fries.

All of these items have a cost involved, which can be an issue for the host. I have seen some friends that have groups do one of several things to offset some of the costs:

* Charge dues - this could be a monthly fee that covers the cost of food/snacks/location
* Use a ips jar system. Most people understand that somebody paid for the snacks and such and are willing to tip generously, when a price is not identified.
* Go to Costco, or some large buying club like that, and buy your snacks and drinks on the cheap. Then, offer them for sale at your gaming party. You can even use the profits to buy the snacks for the next party if there is enough.
* Consider is a potluck type of party. The price of admission is to bring some type of food or beverage.

Finding the Location for Your Group

The first and obvious choice is your home. You need to make sure you have the space and no distractions for this to work. The obvious benefit here is that you have no cost and you control the coordination of the location. The other useful benefit is that you don't have to lug your games to a separate location - you already have them. You can even set them up before everyone arrives. This eliminates the set up time while everyone is socializing at the beginning.

But, what if you have an apartment or are not sure you want a bunch of people coming to your house all the time.

Here are some options for you:

* Independently owned restaurants
* Library
* Community Centers
* Recreation Centers or your local YMCA
* Churches and Synagogues
* Schools (including colleges)
* Game Stores

Usually, game stores are a really good option - you are providing them a set of new customers.

Picking the Right Board Games

This will depend on the type of gaming group you want, and what the people in the group are expecting. For the purposes of this article, I am going to assume you are setting up a board game group.

If you want to introduce the group to European games, you might consider variations of Settlers of Catan, Carcassonne, Ticket To Ride, and Puerto Rico.

Another option might be to bring in some war games. If so, take a look at Memoir '44 and Tides of Iron.

If you have a younger crowd (college level and slightly older) with a lot of time to spend, you may want to hold a full-on gaming day on a Saturday. Then, you can include board games that take more time, like World of Warcraft, Starcraft, or Twilight Imperium.

Another way to increase the variety of games your gaming group plays is to have everyone bring one game - like with the snacks and beverages.

If you are new to board gaming groups, I think it would be wise to start with the simpler games to introduce to a group - that would be the European board games. Then, grow it from there.

Places to Promote Your Group

There are three web sites you should take advantage of if you want to start a gaming group:

* www.boardgamegeek.com - they have listings of gaming groups you can join or advertise your own
* www.meetup.com - you can find others in your local area that may already have a group or you can set up your own.
* www.craigslist.com - this is a great place to promote your budding game group.

Remember, having a board game group that shares your hobby can be a lot of work. But, don't forget the overall goal - to have fun and make new friends! This is a hobby.
